After my DUI conviction, do I have to install an ignition interlock system?

You face stiff penalties if convicted of a DUI in Virginia. One penalty is that your driver’s license could be suspended. However, even if you’re able to get a restricted license, you would be required to install an ignition interlock system in order to obtain one. 

What Is an Ignition Interlock Device? #

An ignition interlock system is similar to a breathalyzer, but it is installed in your motor vehicle. Before starting your auto, you would be required to breathe into the device. If your blood alcohol content (BAC) was 0.02 percent or higher, the system would prevent your ignition from starting.

While you are driving, you would also be required take a “rolling” test every 20 to 30 minutes. If your BAC is above 0.02 percent, your vehicle’s lights and horn would go off until you shut off your engine. Any violations would be reported to your Virginia Alcohol Safety Action Program (VASAP) case manager.

When you get the ignition interlock device, you must also have an electronic log installed. You will be required to submit the log to your VASAP case manager at least quarterly.

How Much Does the Device Cost? #

You must have an ignition interlock system installed by an approved installer. They can charge an installation fee of between $65 to $130. In addition, there is a monthly fee for monitoring and calibrating the device that currently runs at approximately $95. 

If this is your first DUI, you are only required to have the device installed on the one vehicle that you own and drive. You would have to have it installed on all vehicles titled in your name for a second or subsequent DUI offense.

What Are the Penalties for Circumventing the Ignition Interlock System? #

If you drive a vehicle that does not have an ignition interlock system or you tamper with the one on your vehicle, you could be charged with other crimes. Tampering with or trying to circumvent the system is a Class 1 misdemeanor that is punished harshly in Virginia.
