Classes of Felonies in Virginia

  • Class 2. Willful, deliberate, and premeditated murder that does not meet the standards of capital murder is considered to be first-degree murder and is a Class 2 felony. Other Class 2 felonies include arson, kidnapping with the intent to extort money, and aggravated malicious wounding. Punishments include life imprisonment for a period of not less than 20 years and a fine of up to $100,000.


  • Class 3. Crimes that carry a punishment of 5 to 20 years in prison and a fine of up to $100,000 are Class 3 felonies. An example of a Class 3 felony is shooting or stabbing a person with the intent to maim or kill.


  • Class 4. Class 4 felonies result in imprisonment for two to 10 years and a fine of not more than $100,000 and include crimes such as embezzlement, arson of an unoccupied building, prostitution, kidnapping, and manslaughter.


  • Class 5 and Class 6. Some crimes charged as Class 5 or 6 felonies can be charged as misdemeanors, depending on the circumstances of the crime. Offenses include involuntary manslaughter, extortion, animal cruelty, repeat larcenies, reckless endangerment, and others. If charged as a felony, punishments include prison sentences of between 1 and 10 years and fines of up to $2500.
